Question

Explanation of hunting and what relates to it.

Answer

1. Hunting game in ihrām: Besides it being prohibited in ihraam, some fuqahaa hold the view that killing a game animal while in iḥrām is a major sin.
Note: It is not permissible for a muhrim to even indicate to a hunter where the game is or assist him in any way. In doing so, the animal would be _totally haraam_ for consumption for everyone, muhrim and non-muhrim.

2. The Qur`aan is explicit about “ṣayd” being haraam for a muhrim. “Ṣayd” in Arabic can refer to the act of hunting, as well as hunted animals/game (i.e. animals which are normally hunted).
Both, the act of hunting as well as eating from game animals, are prohibited for one in iḥrām.

3. Definition of “ṣayd” (animals of hunt) according to the jurists: An animal that resists capture with its limbs or wings (i.e. it can flee or defend itself), and is naturally wild and untamed from the onset of its creation.

4. If a cow for instance becomes wild or a gazelle becomes tame, their respective rulings would not change as far as ihraam is concerned. The cow would always be halaal for a muhrim even if hunted down due to becoming wild, and the gazelle would always be impermissible for a muhrim even if slaughtered tamely.

6. Ruling on mixed breeds: The animal takes the law of its mother. Thus if the mother is a wild animal, its offspring will be considered game and vice-versa.

(النوع السادس: في الصيد وما يتعلق به) قال الله تعالى: أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَطَعَامُهُ مَتَاعًا لَكُمْ وَلِلسَّيَّارَةِ وَحُرِّمَ عَلَيْكُمْ صَيْدُ الْبَرِّ مَا دُمْتُمْ حُرُمًا، أي محرمين. وقد قال بعض العلماء: إن قتل الصيد من الكبائر. ثم الصيد مصدر، بمعنى الاصطياد، وقد يراد به المصيد، وكلاهما حرام على المحرم. وأراد المصنف تعريف المعنى الثاني (الصيد: هو الممتنع) أي بقوائمه وجناحيه عن أخذه (المتوحش من الناس في أصل الخلقة) أي فلا عبرة بالأمر العارض من الوحشة والأنس (فالظبي والفيل والحمام) يعني ونحوها من البهائم والطيور (المستأنسات صيد، والبعير والبقر والشاة) أي ونحوها من الخيل (المتوحشات ليست بصيد) وأما المتولد من الظبي إن كانت الأم ظبية فهو صيد، وإلا فلا، كما صرح به في الحصر على ما نقله العلامة البرجندي في شرح النقاية .
